Agreement to these terms
These Terms and Conditions form an agreement between you and FitVerx, covering your access to and use of the FitVerx website, software, applications, and related services.
If you use FitVerx on behalf of a company, studio, gym, or other organisation, you confirm that you have authority to accept these terms for that organisation. Our Privacy Policy explains how we handle personal information and is part of this agreement.
Our services
FitVerx provides tools that may include class scheduling and booking, memberships, payments, team management, marketing, branded apps, retail, reporting, integrations, and customer communications. Available features depend on your plan, configuration, and the services selected by your business.
We may improve, update, or change parts of the services over time. When a change materially affects how you use FitVerx, we will provide reasonable notice where practical.
Accounts and acceptable use
You are responsible for providing accurate account details, protecting your login credentials, and all activity that takes place through your account. Tell us promptly if you suspect unauthorised access.
- Use FitVerx only for lawful business and personal purposes.
- Do not copy, resell, reverse engineer, or interfere with the services.
- Do not upload harmful code, unlawful material, or information you do not have permission to use.
- Make sure your use of member and customer information follows applicable privacy and data protection laws.
Plans, fees, and payments
Paid plans are billed according to the pricing, billing interval, and order details shown when you subscribe. You authorise FitVerx and its payment providers to charge the selected payment method for applicable fees, taxes, and approved add-ons.
Keep billing and payment information current so your service can continue without interruption.
Fees are generally non-refundable unless required by law or stated in your order details.
We may update pricing with advance notice. Changes normally apply at the next renewal.
Taxes, transaction charges, and third-party processing costs may apply where relevant.
Your content and responsibilities
You keep ownership of the content, data, branding, and other materials you submit to FitVerx. You give us permission to host, process, display, and transmit that content only as needed to provide, secure, support, and improve the services.
You are responsible for having the rights and permissions needed to submit content, invite users, communicate with members, and process payments through your account. You are also responsible for the accuracy of information and business decisions made using FitVerx.
FitVerx intellectual property
FitVerx and its licensors own the platform, software, designs, trademarks, documentation, and other materials we provide. Subject to these terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the services for your internal business operations.
You may not use FitVerx branding or materials in a way that suggests endorsement, ownership, or a partnership without our written permission.
Suspension and termination
You may stop using the services or cancel your plan according to the cancellation process and billing terms for your account. We may suspend or limit access when reasonably necessary to protect the services, investigate misuse, address non-payment, or comply with law.
When this agreement ends, your right to use FitVerx ends. We may retain or delete account information and content according to our Privacy Policy, legal obligations, and applicable contract terms.
Disclaimers, liability, and contact
FitVerx is provided on an “as available” basis. To the extent permitted by law, we do not guarantee that the services will always be uninterrupted, error-free, or suitable for every business need. FitVerx does not provide legal, medical, financial, or professional advice.
To the extent permitted by law, FitVerx will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the services. Nothing in these terms limits rights or liabilities that cannot legally be limited.
